Terms of use

Public offer granting the right to use the Cassation platform (licence agreement). By starting to use the platform, you accept these terms.

1. Definitions

1.1. Licensor — FOP Yuliia Piskun (individual entrepreneur), Odesa region, Ukraine, Tax ID (RNOKPP) 3469706429, the right holder of the Cassation platform.

1.2. Licensee — a legal entity, bar association, advocate or private legal practitioner who has accepted these terms.

1.3. Platform — the Cassation software suite (web workspace, server side, mobile app, Telegram bot, documentation), accessed via the internet (the Licensor's cloud) or installed on the Licensee's server.

1.4. Materials — documents, files and information that the Licensee and its users upload to the Platform or create with it.

1.5. Analysis results — answers, conclusions, versions of events, debate verdicts, draft documents, suggested deadlines and other results generated by the Platform using artificial intelligence models.

1.6. Trial period (pilot) — 14 calendar days of free or discounted use of the Platform, unless otherwise agreed in writing.

1.7. Users — employees, clients and other persons to whom the Licensee has granted access to the Platform.

2. Subject

2.1. The Licensor grants the Licensee a simple (non-exclusive), non-transferable licence to use the Platform for its intended purpose for the term of the agreement, and the Licensee complies with these terms and pays the fee under the current pricing or a separate agreement.

2.2. The licence does not include rights to the source code, modification, decompilation, copying and distribution of the Platform, creation of derivative products, sublicensing or use of the Platform to build a competing product.

2.3. All exclusive rights to the Platform, its program code, interface, schemas, prompts, model evaluation methods, databases and documentation belong to the Licensor.

3. Acceptance

3.1. Acceptance is any of the following: submitting a pilot request, registering an account, accepting an invitation, logging into the workspace, paying the Licensor's invoice.

3.2. A person accepting on behalf of an organisation confirms that they are authorised to do so.

4. Analysis results are not legal advice

4.1. The Platform is an auxiliary analytical tool. Analysis results are generated by third-party artificial intelligence models, are for information only and do not constitute legal advice, an expert opinion or a forensic examination.

4.2. Artificial intelligence models can make mistakes, reflect the Materials incompletely or inaccurately, and misinterpret legal provisions. The Platform's verification mechanisms (citations inserted by the software, citation checks, debates, control statements) reduce but do not eliminate the risk of errors.

4.3. Procedural and other legally significant decisions, filing of documents, calculation and observance of deadlines are made by the Licensee independently and at its own responsibility. The Platform does not file documents with courts or authorities. Deadlines suggested by the Platform have no effect until checked by the user.

4.4. The Licensee checks Analysis results against primary sources before using them.

5. Materials, AI models and confidentiality

5.1. The Licensee warrants that it is entitled to upload the Materials to the Platform and process them with third-party artificial intelligence models, taking into account attorney-client privilege, professional ethics and personal data protection, and that the Materials do not infringe third-party rights. The Licensee is responsible for the lawfulness of uploading and processing the Materials.

5.2. The Platform uses models from the providers listed on the page AI models, including Z.ai models (GLM). The Licensee chooses the Materials transfer policy («all providers», «no resellers», «local only», region restrictions) in the case settings. Fragments of the Materials are transferred to a provider to the extent necessary for the answer. The Licensor is not liable for the actions of model providers, except where a transfer occurred contrary to the chosen policy through the Licensor's fault.

5.3. The Licensor processes the Materials solely to provide services to the Licensee and does not use their content for model training, advertising or transfer to third parties, other than model providers within clause 5.2 and cases provided by law.

5.4. The Licensor may use anonymised technical information (errors, performance, volume and cost of calls, without the content of the Materials) to operate and improve the Platform.

5.5. On the trial (demo) stand, for security and abuse prevention, the Licensor records user logins and actions, including IP address and approximate location. The content of the Materials is not recorded.

6. Prohibited use

6.1. It is prohibited to use the Platform for: creating or distributing unlawful content; infringing the rights of third parties, including rights to personal data and intellectual property; fraud, misleading the court or parties to proceedings; harassment, discrimination or threats; circumventing restrictions and safeguards of the Platform and the models; extracting models, their weights or training data; automated mass collection of outputs to train competing models.

6.2. Users do not present Analysis results as human-prepared without review where the law or professional rules require disclosure of the use of artificial intelligence.

7. Complaints and content removal

7.1. You can report unlawful or harmful content, infringement of rights or abuse of the Platform at abuse@cassation.app. Describe the issue and attach supporting evidence.

7.2. The Licensor reviews the report without undue delay and, if a violation is confirmed, removes or blocks the content, restricts the user's access and, where necessary, notifies the competent authorities as required by law.

8. Trial period

8.1. The trial period lasts 14 calendar days from the creation of the organisation, unless otherwise agreed in writing. Payment for model costs during the trial is agreed in advance.

8.2. At least 5 days before the trial ends, the Platform shows a warning in the workspace.

8.3. When the trial ends, analysis functions are disabled. For 2 calendar days the Licensee can view and export the Materials and Analysis results.

8.4. After that, all of the organisation's data is deleted from the Licensor's servers irreversibly, unless the parties have concluded a paid agreement or extended the trial. The Licensee exports the data it needs in good time.

9. Data export and project closure

9.1. The Licensee's administrator may export the organisation's data at any time using the Platform's tools. Export to other formats and migration to other systems are performed under a separate agreement.

9.2. The Licensee's administrator may close the project in the workspace. From closure, users' access ends and the organisation's data is deleted. Closure is irreversible.

9.3. Copies in backups are deleted on scheduled overwrite, no later than 30 days. Backups are not used to restore data of closed organisations.

10. Fees and model costs

10.1. The fee is set by the pricing on the website or a separate agreement. Payment for artificial intelligence model costs (with the Licensee's keys or via the Licensor) is set by agreement of the parties.

10.2. Estimates shown by the Platform before running operations are indicative. The actual cost is determined by the Platform's accounting and the model providers' rates, which providers may change unilaterally.

10.3. The Licensee sets spending limits in the Platform itself and is responsible for spending within them.

11. Availability and changes to the Platform

11.1. The Platform is provided «as is». The Licensor makes reasonable efforts to keep it operational but does not guarantee uninterrupted and error-free operation or a specific result. Availability levels are set only by a separate agreement.

11.2. The Licensor may change the Platform's functionality, the set of models and providers, and carry out maintenance.

11.3. The Licensor is not liable for interruptions caused by model providers, hosting, communications, messengers, app stores or force majeure.

12. Limitation of liability

12.1. The Licensor is not liable for lost profits, indirect damages, loss of goodwill, unfavourable case outcomes, missed procedural deadlines or consequences of using Analysis results, nor for damages caused by the Licensee's users, third parties or model providers.

12.2. The Licensor's aggregate liability is limited to the fees actually paid for the 3 months preceding the event giving rise to the claim; during the trial — to 100 euros.

12.3. These limitations do not apply where the law expressly prohibits limitation of liability.

13. Licensee's obligations

13.1. The Licensee does not give account access to outsiders, keeps passwords secure, promptly reports unauthorised access, does not attempt to circumvent restrictions, does not probe for vulnerabilities without the Licensor's consent and does not overload the Platform with automated requests.

13.2. The Licensee is responsible for the actions of users to whom it has granted access, including their compliance with sections 5 and 6.

13.3. If these terms are breached, the Licensor may suspend access with notice.

14. Term, amendment and termination

14.1. The agreement is effective from acceptance until termination.

14.2. The Licensor may amend these terms by publishing a new version on the website at least 10 days before it takes effect. Continued use of the Platform means acceptance of the new version.

14.3. Either party may terminate the agreement by notifying the other; the Licensee may also do so by closing the project in the workspace. Fees paid for the elapsed period are not refunded.

15. Personal data

15.1. Personal data on the website is processed under the Privacy policy. For personal data contained in the Materials, the Licensee is the controller, the Licensor is the processor acting on the Licensee's instructions, and model providers are sub-processors.

16. Governing law and disputes

16.1. The agreement is governed by the law of Ukraine. Disputes are resolved through negotiation and, failing agreement, by the court at the Licensor's location.
